Terms of service

A.  Introduction 

 

1.  Welcome to the online store of ERAA Cosmetics (hereinafter: `the Website`). The Website is operated by ERAA Cosmetics Ltd. (hereinafter: `the Operator`), Company No. 517365441, and serves as an e-commerce platform for the sale and marketing of makeup and skincare products by ERAA Cosmetics.

2.  Use of the Website is subject to the terms set out in these Terms of Use (hereinafter: `the Terms`). The Terms constitute a legally binding agreement between you and the Operator, and apply to all use of the Website — whether direct or indirect — including browsing, making purchases, registering on the Website, contacting customer service, and any other action performed through the Website. If you do not agree to any of these terms, please refrain from using the Website.

3.  The Operator may amend and/or update the Terms at any time, at its sole discretion and without prior notice. Any amendment and/or update will take effect immediately upon publication on the Website, and any use of the Website following such publication constitutes full acceptance of the updated Terms. Where your explicit consent to changes is required, use of the Website will only be permitted after such consent is obtained.

4.  In the event of any conflict between the Terms and any content published on the Website, the Terms shall prevail.

5.  These Terms are written in the feminine form for convenience only and apply to all users regardless of gender.

6.  All headings in these Terms are for convenience only and shall not be used to interpret any clause or provision.

 

  B.  Use of the Website 

 

7.  The Website is open to any person over the age of 18 who has legal capacity to perform legal acts under applicable law and holds a valid Israeli credit card issued by a recognised credit company (hereinafter: `Customer` or `User`). Use of the Website is for private and personal purposes only. Any commercial or wholesale use requires the prior written approval of the Operator.

8.  To place an order on the Website, the User must hold a valid email address, provide a delivery address within the State of Israel, and enter correct and accurate details at the time of ordering.

9.  The User undertakes to use the Website lawfully and to refrain from any action that may harm the Operator, the Website, or other users. The following actions are strictly prohibited on the Website (non-exhaustive list):

a.        Using false details or the identity of another person.

b.       Hacking, unauthorised access, or any attempt to harm the Website's infrastructure.

c.        Copying, distributing, or making commercial use of content from the Website without prior written approval from the Operator.

d.       Attempting to bypass security restrictions or collect personal information about other users.

e.        Impersonation, fraud, or abuse of the system, including disrupting Website activity.

10.  The Operator may, at its sole discretion and without prior notice, block or remove access to the Website — temporarily or permanently — from any User who violates these Terms or acts contrary to applicable law, or whose use goes beyond normal Website use or harms the Operator's reputation or services.

 

  C.  Registration and Account Creation 

 

11.  Use of the Website does not require registration or the creation of an account. However, Users may register and open a personal account in order to manage orders, view purchase history, receive benefits and updates, and enhance their experience. The Website is open to the general public, including professional makeup artists.

12.  During registration or when placing an order, the User will be asked to enter personal details such as full name, email address, phone number, delivery address, and a password (for registration). The Operator may request additional details at its discretion. Details entered at the time of registration will be stored in the Operator's database in accordance with applicable law. The User declares that they are providing their details of their own free will and are not legally obligated to do so.

13.  The User may also subscribe to marketing content, updates, promotions, benefits, and special offers from the Website, subject to explicit consent. Communications will be sent via various channels, including email, SMS, WhatsApp messages and/or any other means of communication. The User may unsubscribe at any time via the unsubscribe link in any communication received, or by contacting customer service at the details set out below. Removal from the mailing list will be completed within two business days of receipt of the request.

14.  The User is responsible for entering correct and accurate details at the time of registration or when placing an order, and for updating them whenever changes occur. The Operator will not be liable for any delay or failure in delivering products caused by the entry of incorrect details or failure to update them.

15.  The password chosen during registration is personal. The User is responsible for keeping it confidential and must not share their login details with others. It is recommended to change the password periodically for privacy and data security purposes. Unauthorised use of an account constitutes a breach of these Terms.

16.  The User may request the deletion of their account at any time by contacting customer service using the contact details set out below. The Operator will delete the account and the User's personal details within 7 business days of receiving the request.

17.  Commercial users who have been authorised to make wholesale purchases or sell to third parties are required to register and create an account in order to place orders and receive their applicable benefits.

 

  D.  Purchasing Products on the Website 

 

18.  The Website enables the online purchase of makeup products, skincare items, and related accessories from the range displayed on the Website, subject to available stock.

19.  The Operator reserves the right to update product prices on the Website at any time, including as part of promotions, discounts, or routine price updates. The binding price is the one displayed on the Website at the time the User completes their order.

20.  The purchasing process on the Website includes: selecting products, adding them to the shopping cart, proceeding to the checkout screen, entering delivery and payment details, and finally confirming the order.

21.  Product prices displayed on the Website include VAT (where applicable) and may change from time to time at the Operator's sole discretion. As the Website operates and is updated in real time around the clock, there may be discrepancies between the price displayed when viewing a product and the final price at checkout. The binding price is the price shown in the shopping cart at the time of completing payment.

22.  When placing an order, the User is required to provide complete and accurate details: full name, delivery address, phone number, email address, and payment details. Following completion of the order, an automatic confirmation email will be sent to the User's email address. This confirmation does not constitute a commitment to supply.

23.  Order confirmation on the Website is issued automatically and does not constitute final approval of the transaction. The Operator reserves the right to cancel a transaction due to a price error, product detail error, or unavailability, with appropriate notice provided to the Customer.

24.  Payment on the Website is made by credit card (excluding Diners Club and Israel Post Bank prepaid cards) via a secure payment processing system. Credit card details are not stored in the Website's systems and are not accessible to the Operator.

25.  If a product that has been ordered cannot be supplied, the Operator may, at its discretion, cancel the order for the out-of-stock item, or notify the User and offer a choice between a full refund for that product or a replacement item.

26.  The Operator reserves the right to cancel or decline to approve an order at its discretion, including in cases of incorrect details, suspected use of a stolen credit card, unauthorised wholesale activity, use of false details, bad-faith conduct in connection with use of the Website, a payment that was not approved, or insufficient stock.

 

  E.  Delivery & Shipping 

 

28.  Products purchased on the Website will be delivered to the address provided by the User at the time of ordering, via an external courier company. Self-collection is not available.

29.  Standard delivery time is up to 8 business days from the date of order approval by the Operator. For remote areas, delivery time is up to 10 business days. During peak periods, there may be a delay of up to 7 additional business days. Pre-sale orders have a delivery time of up to 20 business days.

30.  Business days are counted as Sunday through Thursday only, and do not include Fridays, Saturdays, public holiday eves, public holidays, or national closures. A business day on the Website ends at 16:00, unless otherwise stated.

31.  Shipping fees will be charged as part of the order and will appear separately from the product total. In cases of special delivery requirements (e.g. heavy or large packages, buildings without a lift, remote areas, etc.), an additional charge may apply, to be coordinated with the User in advance.

32.  Responsibility for providing correct delivery details lies solely with the User. In the event of non-delivery or return of the package to the Operator due to an incorrect address or failure to respond, the User will be charged double shipping fees (outbound and return).

33.  In areas that are restricted or inaccessible to the courier company, the Operator and/or the courier company may deliver the package to a nearby and suitable location, with prior notice to the User. The User is responsible for verifying, at the time of placing the order, that delivery to the requested address is possible.

34.  The Operator is not responsible for delays caused by circumstances beyond its control, including strikes, extreme weather conditions, or force majeure events.

35.  The Operator reserves the right to update the delivery method based on actual availability of courier services at the time of supply.

36.  Complaints regarding delays in delivery should be sent to customer service at the email address set out below, detailing the nature of the complaint. The Operator will investigate the complaint, and if a delay is confirmed that is not caused by force majeure or events outside the Operator's control, the User may cancel the order and receive a full refund for the products purchased.

37.  Once the package has been handed over to the courier company, the User will receive a notification (by email and/or SMS) containing the shipping details and tracking number — where available.

 

  F.  Cancellations & Returns 

 

38.  The User may cancel a transaction in accordance with the provisions of the Consumer Protection Law, 5741-1981 and the regulations made thereunder (hereinafter: `the Law`). Notice of cancellation may be submitted by: a dedicated cancellation link on the Website, or by email — in accordance with the customer service details set out below.

39.  In the case of cancellation by a person with a disability, senior citizen, or new immigrant, the transaction may be cancelled within four months from the date it was made, the date of receipt of the product, or the date of receipt of the transaction details document — whichever is later — provided that the transaction involved a conversation between the Operator and the User (including via electronic communication). The Operator may request that the User provide documentation as specified under the Law to confirm their status.

40.  Cancellation of a transaction may be made within 14 days of the actual receipt of the product. Users wishing to cancel are requested to return the product in its original packaging, unused, undamaged, and in its original sealed condition.

41.  A refund will be processed within 14 days of receipt of the cancellation notice, provided that the product has been returned in accordance with the conditions above. The refund will be made to the original payment method used for the purchase. No refund will be given for products for which no monetary consideration was paid — including gifts.

42.  In the event of cancellation due to a product defect, non-conformity with the order, or an error on the part of the Operator, the User will be entitled to a full refund of the total amount paid in the transaction, including shipping fees and return costs, where applicable.

43.  Where cancellation is not due to a defect, non-conformity, or error on the part of the Operator, the User shall return the product at their own expense to the Company's offices at 6 HaHarash Street, Petah Tikva. Alternatively, the User may arrange collection by courier at their own cost. In such cases, the Operator may charge a cancellation fee of up to 5% of the transaction value or ILS 100 — whichever is lower.

44.  Exchanges or store-credit returns may be made up to 40 days from the date of the transaction, provided that the product has not been opened, used, or damaged and is returned in its original sealed packaging, accompanied by the original invoice.

 

  G.  Liability & Disclaimers 

 

45.  The Website and all services and content included therein are offered to the User on an `as-is` basis, without any warranties or commitments on the part of the Operator.

46.  Use of the Website, its content, and the products sold therein is at the User's sole risk. The Operator is not liable for any direct or indirect damage arising from use of the Website, including the purchase of products or reliance on information contained therein.

47.  The products sold on the Website are intended for cosmetic use only and do not constitute a substitute for medical advice, medical treatment, or professional diagnosis. Users are advised to check the product ingredients before use and, in the event of a known sensitivity or unexpected reaction, to discontinue use and consult a doctor. The Operator is not responsible for use that does not comply with the instructions on the packaging or the product's intended purpose.

48.  The Operator makes every effort to provide reliable information, proper service, and continuous Website availability, but does not guarantee this. Interruptions, technical faults, good-faith errors, or disruptions beyond its control may occur.

49.  Product images, videos, and illustrations on the Website are for illustrative purposes only. There may be minor differences between the product's appearance on the Website and the product actually received, including in shade, texture, or packaging. Such differences do not constitute a claim of non-conformity.

50.  Where the Website contains links to third-party websites, the Operator is not responsible for their content, reliability, or operation, and use of such sites is at the User's sole risk.

51.  The Operator is not responsible for unauthorised use by third parties, including hacking attempts or misuse of the User's details, provided such actions did not result from negligence on the part of the Operator.

52.  The User undertakes to keep their account login details confidential and not to disclose them to third parties. Any damage caused to the Operator or third parties as a result of the User's negligence in safeguarding such details will be the User's responsibility, and the User shall be fully liable to compensate and indemnify the Operator accordingly.

 

  H.  Privacy Protection 

 

53.  Your privacy matters to us. When using the Website — particularly when registering or making a purchase — Users provide personal details including name, address, email address, phone number, and payment details. Credit card details are not stored in the Website's systems, and payment is processed via an external payment processor operating to PCI-DSS security standards, secured by SSL protocol.

54.  Further information on how personal data provided by Users is used can be found in the Privacy Policy, available on a dedicated page on the Website. The Privacy Policy forms an integral part of these Terms.

 

  I.  Prohibited Uses of the Website 

 

65.  The User undertakes to use the Website and its content in accordance with these Terms and all applicable law, and to refrain from any action that may harm the Website, the Operator, other users, or third parties.

66.  The User's personal account — including any rights or benefits accumulated therein — may not be sold, transferred, or assigned in any manner, whether for payment, benefit in kind, or by any other means.

67.  The User may not use any software, scripts, or other automated means designed to access, collect information from, perform actions on, or affect the normal operation of the Website or the services offered therein.

68.  Without limiting the foregoing, the User is prohibited from performing any of the following acts on or in connection with the Website:

f.        Unauthorised access to the Website's servers, accounts, or systems.

g.       Use of a fictitious identity or providing false details.

h.       Infringing the copyright, trademarks, or other intellectual property rights of the Operator or of third parties.

i.         Copying, reproducing, distributing, translating, broadcasting, or publishing content from the Website without permission.

j.         Modifying, disrupting, reverse-engineering, or any attempt to trace the source code or technical structure of the Website.

k.       Distributing unlawful, offensive, or harassing content through the Website.

l.         Using any robot, script, search engine, or other automated tool to scrape or collect information from the Website without prior written approval.

69.  Any unauthorised use as described above will be considered a breach of these Terms and will entitle the Operator, at its discretion, to block the User, cancel orders, and take any necessary legal action.

 

  J.  Intellectual Property 

 

70.  All intellectual property rights in the Website — including but not limited to: Website design, texts, images, videos, audio files, trademarks, logos, products, descriptions, graphics, source code, and all other content — belong exclusively to the Operator or to third parties who have licensed their use. Any use not in accordance with these Terms and applicable law constitutes a copyright infringement.

71.  No content on the Website may be copied, reproduced, published, distributed, sold, translated, publicly displayed, or otherwise used — in whole or in part — without prior written approval from the Operator.

72.  The trademarks and logos appearing on the Website are the property of the Operator or of third parties. They may not be used in any way that creates an impression of a connection, sponsorship, or endorsement by the Operator, unless explicit written approval has been granted.

73.  Use of the Website does not grant the User any right, licence, or permission in respect of the intellectual property of the Operator or of third parties, unless expressly stated otherwise in writing.

74.  Any content uploaded to the Website by the User (such as reviews, opinions, ratings, etc.) does not confer on the User any proprietary right, licence, or ownership over the Website, its services, or any related information.

75.  A user who uploads to social media a photograph featuring the brand's products and tags the brand or the Company's Instagram account, or uses the Company's unique hashtag (e.g. #eraabeauty), hereby grants the Company permission to use that photograph for sharing on social media, on the Website, or in marketing materials, without incurring any obligation or conferring any right. A user who wishes to have their photograph removed may contact customer service, and the Company will remove the photograph within one business day of confirmation.

76.  Content from the Website may not be used on other platforms, websites, social networks, or commercial systems — including for profit, advertising, sales promotion, or marketing purposes — without prior written approval from the Operator.

 

  K.  General Terms 

 

77.  These Terms constitute the entire and exclusive agreement between the User and the Operator in connection with the use of the Website. Any prior agreement, whether written or oral, is null and void upon these Terms coming into effect.

78.  The Operator reserves the right to update or amend the Terms at any time, at its discretion, without prior notice. Any such amendment will take effect immediately upon publication on the Website.

79.  If any provision of these Terms is found to be unlawful or unenforceable, such finding will not affect the validity of the remaining provisions, which will remain in full force and effect.

80.  Any waiver, delay, or non-enforcement of any right conferred on the Operator under these Terms will not be deemed a waiver of that right or any other right.

81.  Exclusive jurisdiction in any matter relating to these Terms, use of the Website, and business activity between the User and the Operator will vest solely in the competent courts in Tel Aviv.

82.  The governing law applicable to the use of the Website and to these Terms is Israeli law only.
